Courts

The courts are divided into three sections, which are as follows:

  • Supreme Courts: These courts represent the top of the judiciary pyramid in Sultanate of Oman.
  • Appeal Courts: These courts are competent to hear appeals raised from judgments that may be legally appealed.
  • Primary Courts: These courts are courts of first instance as disputes are files at these courts for the first time.

Litigation Proceedings

In case of any dispute between adversaries regarding civil, commercial, personal or labor cases, the plaintiff can refer to the conciliation committee of concern directly or seek refuge to the court.

Performance orders

If the right of creditor is approved in writing and becomes mature and all that is claimed is indebted money of determined value or moveable specified for itself, its type or quantity, the entitled party shall instruct the indebted person to fulfill payment within a period of eight days at least, and if such party fails to pay, the entitled person has to request from the Primary Court.

Appeal for reconsideration

The litigants are eligible to request reconsideration of judgments issued by court of first instance and not subject to objection by appeal due to lack of quorum in a number of cases and there is a deadline for the petition, which is thirty days The petition is also filed with the court in accordance with the conditions and procedures established for filing the case.

Objection in civil & commercial suits before the Supreme Court

The litigants may object before the Supreme Court regarding any judgments issued by appeal courts in the following cases:

  • If the objected judgment is based on violation of law or erroneous application or construe.
  • If judgment is null or nullity of procedures affects judgment.

Appeal in civil and commercial lawsuits

After serving the judgment to the litigants during the situations not exempted by law, they can appeal against judgments of courts of first instance issued at the primary level and they are eligible to appeal regarding urgent matters issued by whatsoever court, and agreement may be reached even if before filing the case subject that the judgment of the court of first instance shall not be subject to objection through appeal for lack of quorum.

Execution

Writs subject to compulsory execution are:

  1. Judgments and orders.
  2. Attested instruments and minutes of conciliation approved by courts or committees of conciliation & reconciliation.
  3. Other papers categorized by law in the capacity of writ of execution.

Offer and deposit

The debtor if requires a quittance and clearance shall offer the creditor in its domicile a real offer towards what he obligated self to perform or money, documents or movables and the offer is provided first through registered mail with delivery notice and there are several procedures and conditions for a valid offer.

Doctrinal certificates and inheritance

The court within its department that the latest residence of any deceased person is located, shall confirm the death and determine heirs, their capacity, adults and minors or the likes and certification of inheritance and settlements.
That shall be through an application to the court by party requiring investigation whether heir or devisee or legatee including date of demise and last residence to the deceased, names of heirs, devisees and legatees and their domicile.
